I was contacted by my gym that informed me that they are going to reopen. But the pool space doesn't open, which for me is fundamental. Can I cancel the contract?

Normally, the contract entered into with the gym takes the nature of a service provision contract fitness, where several services are included, among them, the swimming pool. For this reason and first of all, we advise you to consult your contract or, if you do not have it, ask the gym for a copy of it to understand what services are included.

If the pool is part of these services, globally, the impossibility of use does not in itself confer the right to cancel the contract, so you should seek a solution by agreement with your gym that involves, for example, the reduction of the price.

The contract with my gym, started in January this year, has a 24-month loyalty, so I ask you for information about its cancellation. Although the gym is already open, it is not meeting the conditions communicated by DGS, which is why I want to cancel the contract.

The fact that the gym is not yet able to reopen does not mean that it will not be able to do so in a short time. In this case, the consumer has the right to maintain the benefits related to the payment of the price suspended, but may, however, be obliged to remain loyal.

  • Before returning to the gym, contact and ask for information about the new mode of operation and about the changes verified. Subsequently request receipt of this information in writing, for example, by email.
  • Consult the gym rules and see if there is any matter related to suspension of payment due to unforeseen circumstances or force majeure
  • Ask for a copy of the contract and check what is foreseen in view of the specificity of the service you have contracted.
